To play, simply purchase WhereToWee from the iTunes App Store and register the App. Once registered, every time you add a new restroom with a photo, you will be entered for the Grand Prize and for the current month's iPhone draw.

MONTHLY PRIZES - Monthly draw for a 16GB iPhone 3GS

WhereToWee Inc. will provide one monthly prize of one 16GB iPhone 3GS, to be drawn December 10, 2009, January 10, 2010, February 10, 2010 and March 10, 2010. To play, simply purchase WhereToWee from the iTunes App Store and register the App. Once registered, every time you add a new restroom with a photo, you will be entered for the Grand Prize and for the current month's iPhone draw.

WEEKLY PRIZES - Draw for $10 iTunes Gift Certificates when you play the 'Wee Here - Not There' game

WhereToWee Inc. will provide one weekly prize of one $10 iTunes Gift Certificate, to be drawn once a week from December 11, 2009 and concluding March 26, 2010. To be entered, simply register, login and play the 'Wee Here - Not There' game at www.wheretowee.com. No purchase necessary. When logged in, every vote in the game grants one (1) entry in the contest.

HOW TO REGISTER YOUR WHERETOWEE APP

1. Download and install WhereToWee from the iTunes Store
2. Start WhereToWee
3. Click on the 'Help' button at the bottom right of the screen
4. Choose 'Register'
5. Add your email address
6. Your iPhone and email address are registered. Now for every restroom you add with a photo, either through your phone or when logged in to the website, you will be given one entry to the iPhone and Grand Prize draws.

Eligibility:

The “Contest”, offered by Wheretowee Inc., is open for entry to legal residents of all countries where permitted by law, and void where prohibited or restricted by local laws.

Individuals wishing to enter the Contest shall follow the process of entry described on the Contest link on this site, and shall be deemed “Participants” once any such entry is submitted.

Participants must be at least 18 years of age or older as of the date entry, or the required legal age for Contest participation as required by local laws.

No employee of Wheretowee Inc. or his or her immediate family is eligible to participate in the Contest.

Participants agree, by their entry in the Contest, that they have read and understood these Contest Rules and agree to be bound thereby.

In addition to these Contest Rules, Participants agree to be bound by the Terms and Conditions of Use of this website.

Wheretowee Inc. shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof as may be requested, and/or to provide any untruthful, inaccurate, incomplete or misleading information shall result in disqualification from the Contest.

Contest Period:

The Contest begins at 00:01 (time) on 23 day, November, 2009 and closes at 23:59 (time) on 31 day, March, 2010 after which time the Contest will be closed and no further entries will be accepted.

How to Enter:

No purchase necessary to participate in the draw for iTunes Gift Certificates, hereafter referred to as the “Game Contest”.

To enter the Game Contest, participants must register with a valid email address and password and must then log into the WhereToWee.com website. Logged in participants will receive one entry for every vote made on the ‘Wee Here – Not There’ game.

The WhereToWee iPhone App must be registered to participate in the draw for an iPhone or the Grand Prize, hereafter referred to as the “App Contest”.

Participants in the App Contest are to submit a photograph and description of the bathroom using the WhereToWee App or through the WhereToWee.com website.

Participants by submitting an entry, represent and warrant, that the entry does not contain any material that is defamatory, libellous, profane or obscene, and that any photographs, text or other descriptions that are submitted are the original work of the Participant and all right, title and interest (including copyright) is owned and/or controlled by the Participant to the full extent necessary to enable Wheretowee Inc. to use the entry in any manner including all manners as contemplated by these Contest Rules, and that the entry does not infringe upon the intellectual property or other statutory or common law rights of any third party.

There are no limits as to the number of entries by each Participant. Only one bathroom location per participant will be accepted.

All entries, including all photographs, texts and descriptions, submitted by a Participant become the sole property of Wheretowee Inc. and none will be returned for any reason. Entries must be submitted within the Contest Period defined above. Entries will be declared invalid and ineligible for the Contest if they are late, illegible, incomplete, damaged, irregular, mutilated, or forged, which declaration shall be at the sole discretion of Wheretowee Inc.

INTERNET ACCESS AND EMAIL REQUIRED TO ENTER AND WIN.

Prize and Selection of Winner:

The “Winner” of each contest shall be declared by Wheretowee Inc. based upon a random draw.. The final determination of the “Winner” shall be made by Wheretowee Inc. and such decision shall be final and binding.

The prizes awarded to the winners of the Game Contest shall be:

Eighteen (18) prizes of one (1) $10 iTunes Gift Certificates. One prize will be awarded weekly beginning November 27, 2009 and concluding March 26, 2010.

The prizes awarded to the winners of the App Contest shall be:

(Restrictions Apply): Four (4) prizes of one (1) Apple Gift Card valued at the value of one (1) iPhone 3GS, 16GB, in the winner’s country. WhereToWee Inc. is not responsible for taxes, service charges, obligatory contractual agreements with service providers, or currency exchanges. The Apple Gift Card can be applied only to qualified purchases directly from Apple at an Apple Store or the Apple Store online.

(Restrictions apply): One (1) Grand Prize winner of two (2) return flight airfare tickets with Air Canada to- and from- Air Canada destinations within North America. Origination point of flight must be an Air Canada destination within North America.

One (1) Grand Prize winner will receive two (2) ticket vouchers good for a round-trip flight within North America anywhere Air Canada flies (two total ticket vouchers, each voucher valid for one (1) passenger). All prizes will be awarded as an Air Canada ticket voucher expiring 04/02/2011 and are subject to the voucher requirements and restrictions, such flight restrictions as may be imposed by Air Canada and other general flight restrictions. Flights are subject to availability. All reservations and travel arrangements must be made by the winner directly with Air Canada. 
Travel to and from the departure/arrival airports, transfers and all other trip fees, costs, taxes or expenses whatsoever of any nature are the responsibility of Winner.

Before being declared the Winner and receiving the Prize, the Participant selected shall be required to correctly answer a time-limited mathematical skill testing question.

There will be no substitution of the Prize and no cash awarded in lieu thereof.

The Prize is awarded “as is” with no warranty or guarantee, either expressed or implied. All Prize details are at Wheretowee Inc.’s sole discretion. Wheretowee Inc. reserve their right, in their sole discretion, to substitute a prize of equal or greater value, if the Prize, or any portion of it, becomes unavailable or impractical to provide.

Any costs and expenses associated with the Prize and its acceptance and use thereof, are the Winner’s sole responsibility, including any and all taxes or other incidental costs associated with the use of the Prize.

The Winner shall be required to execute an acknowledgement of the Contest Rules and his or her compliance therewith, and a full Release and Indemnity before receiving the Prize.

The Winner shall grant Wheretowee Inc. the right to publish, reproduce, distribute, broadcast or communicate the Winner’s name, photograph, likeness, voice and/or biography on the site or affiliated sites or on any other media, at Wheretowee Inc.’s sole discretion, in promotion of the Contest or the Wheretowee.com website, affiliated site or application.

Waiver/Disclaimer of Liability:

By entering, Participants agree to release, discharge, indemnify and hold harmless Wheretowee Inc., including their affiliates, subsidiaries, and successors in interest, directors, officers, employees and agents, from any and all liability, claims, judgments, losses, injuries, demands, damages, actions and/or causes of action, whether direct or indirect, which may be due to or arise out of the participation or entry in the Contest or any portion thereof, or the acceptance, use or misuse or possession of the Prize or of Wheretowee Inc.’s use of any of the rights granted herein. All applicable local laws and regulations may further apply.

The Participant, by providing his or her entry, agrees to fully indemnify, including full solicitor and client legal costs, Wheretowee Inc., including their affiliates, subsidiaries, and successors in interest, directors, officers, employees and agents, from any and all claims or demands by third parties relating to my entry, participation in the Contest, or acceptance and use of the Prize.

The Participant acknowledges and agrees that any provider of prizes or other consideration for this contest shall not have, nor in the future shall have any duty, liability or obligation, direct or indirect, vicarious, contributory, through agency or otherwise, to the Participant or any third party for any claims, judgments, losses, injuries, demands, damages, actions or causes of action which may be due or arising out of any participation in the Contest, including any submissions, postings, photographs, comments, words, statements or opinions posted on Wheretowee.com or any related site or application, or through any acceptance, use or misuse of the Prize(s).

Entry Requirements:

Wheretowee Inc. reserves its right to edit, delete, disqualify or modify any entry in its sole and unfettered discretion.

All entries must comply with the following guidelines, or will be subject to disqualification:

• Entries cannot be obscene, offensive or inappropriate as deemed by Wheretowee Inc. in its sole discretion
• Entries cannot be sexually explicit or suggestive, profane or pornographic
• Entries cannot be defamatory, untruthful, slanderous, libellous or misrepresenting of the scene or circumstances depicted or described
• Entries cannot contain copyrighted materials owned by others used without permission
• Entries cannot communicate images or messages inconsistent with the images, messages or goodwill to which Wheretowee Inc. and/or the Sponsor wishes to associate
• Entries cannot depict, and cannot itself, be in violation of any law
• Participants cannot tamper with or attempt to tamper with the entry process or the operation of the Contest in any way
• Participants cannot act in a disruptive or unsportsmanlike manner, or with an intent to annoy, abuse, threaten or harass anyone
• Only one entry per bathroom location per Participant permitted. Multiple submissions of the same bathroom location by Participant will be discarded.
• Entries must be a public restroom.

Privacy:

By becoming a Participant, the Participant grants Wheretowee Inc. the right to use his/her name, mailing address, telephone number and email address for the purpose of administering the Contest, including but not limited to contacting and publically announcing the Winner.

All personal information collected will be treated in a manner consistent with the Wheretowee Inc. Privacy Policy found on this site.

Termination or Modification:

Wheretowee Inc. reserves the right, in its sole discretion, to terminate the Contest, in whole or in part, and/or modify, amend or suspend the Contest and/or the Contest Rules in any way, at any time, for any reason, and without further specific notice to each Participant.
